What this means
If enacted, this would pause for 12 months approvals for data centers that have not started substantial on-site construction, creating a major delay for new projects and expansions (applications would be held during the moratorium). It would not stop operation of existing data centers or apply to those already under construction, so it is a severe temporary restriction rather than a complete ban.
Timing

- twelve (12) months from the date of publication unless further extended by the Governing Body
The moratorium applies to covered data-center applications and projects, with stated exceptions for data centers already under construction and repair or replacement of existing data centers.

Restrictions & requirementsHide restrictions & requirements6
Imposes a 12-month moratorium on processing, considering, approving, or issuing licenses, permits, approvals, permitted or special uses, site plans, conditional uses, rezonings, variances, and other authorizations for establishing, constructing, or converting a building or structure to data-center use within the City.
Applications for data centers that have not begun on-site construction must be held in abeyance during the moratorium, and related application deadlines are tolled for the moratorium's duration.
The moratorium applies unless on-site construction has commenced through substantial physical site work, such as grading, excavation, or foundation installation; design, engineering, permitting, financing, equipment procurement, and contractual commitments do not qualify as on-site construction.
Data centers currently under construction and the repair or replacement of existing data centers are exempt from the moratorium.
An applicant may withdraw an application delayed by the moratorium and receive a refund of fees paid to the City.
The moratorium remains effective for 12 months from publication and may be extended by the Governing Body.
Benefits & exceptionsHide benefits & exceptions2
Data centers already under construction are exempt from the moratorium, so construction may continue. This applies only after substantial on-site physical work has begun, such as grading, excavation, or foundation installation.
Existing data centers may be repaired or replaced despite the moratorium.
