The Data Center Divide

Franklin County

Neutral Data Center Policies

Franklin County allows buildings up to 70 feet in its Regional Enterprise Park district, where data centers are permitted, subject to site and utility requirements.

current law · County measure
Franklin County’s zoning code governs development in the Regional Enterprise Park District, including the reported by-right treatment of data centers at Summit View Business Park.Franklin County Code of Ordinances, Chapter 25 (Zoning), Division 13 — Regional Enterprise Park District (REP) (2026)

What this means

The measure modestly helps data center construction by raising the maximum building height in the Regional Enterprise Park district from 50 to 70 feet, where data centers are a permitted use (height increase; data center permitted). It applies across the district rather than specifically to data centers, and the district still has site and utility requirements; it does not provide special operating benefits.

People behind it

  • Proposed and adopted the amendment to the Regional Enterprise Park District's building-height regulation.

Restrictions & requirementsHide restrictions & requirements11
  • A property must contain at least 200 contiguous acres to be rezoned to the Regional Enterprise Park District, where data centers are permitted.

  • Data center buildings may not exceed 70 feet in height unless the Board of Supervisors approves a special use permit. Belfries, cupolas, chimneys, flues, flagpoles, television antennae, radio aerials, silos, and water tanks are exempt.

  • A minimum setback of 50 feet from Route 220 and 35 feet from other roads is required for principal structures, including porches, stoops, and accessory buildings.

  • Minimum side and rear setbacks are 25 feet, increased to at least 80 feet for buildings, structures, accessory uses, and outdoor storage areas adjoining residential or agricultural zoning districts.

  • A landscaped yard of at least 50 feet is required along Route 220 and 25 feet along other roads. Buildings, parking areas, outdoor storage, and outdoor displays are prohibited in these yards, although driveways are allowed.

  • Off-premises signs are prohibited. Developments requiring a concept plan must also submit a signage plan identifying the location, design, size, height, and arrangement of all proposed freestanding signs.

  • All new roads or streets must meet VDOT standards for acceptance into the state-maintained secondary-road system, and new public or private street entrances must meet VDOT standards for separation, sight distance, turning radius, and corner clearance. Parcels along Route 220 must also comply with the 220 North Corridor Plan and related overlay regulations.

  • Utilities must be placed underground on parcels being developed or redeveloped.

  • Ground- and wall-mounted mechanical or electrical equipment must be screened from general public view. Roof-mounted equipment, satellite dishes, and other communications equipment must be concealed from public rights-of-way and neighboring properties at street level; if screening walls are insufficient, equipment must be painted a neutral color.

  • A site plan is required for every use before a building permit or zoning permit may be issued. Property rezoned to the Regional Enterprise Park District must also establish private covenants and regulations governing uses and standards in the park.

  • Data centers must comply with the countywide minimum off-street parking requirements in Sections 25-80 through 25-82 and minimum loading-space requirements in Section 25-85.

Benefits & exceptionsHide benefits & exceptions5
  • Data centers are permitted uses, so they do not require a special-use permit in the REP district, subject to required zoning and building permits.

  • Maximum floor area is not regulated, allowing data centers to be built or expanded without an REP-specific floor-area cap.

  • Buildings may be up to [70 feet high](https://library.municode.com/va/franklin_county/codes/code_of_ordinances?nodeId=COCO_CH25ZO_ARTIIIDIRE_DIV13REENPADIRE#:~:text=maximum%20height%20of%20buildings, seventy%20(70)%20feet) without a special-use permit; greater height requires approval by the Board of Supervisors. Belfries, cupolas, chimneys, flues, flagpoles, antennas, silos, and water tanks are exempt from the height limit.

  • The district allows large-scale campus development because any area rezoned to REP must contain at least 200 contiguous acres, subject to that minimum-size condition.

  • The access rules provide defined requirements for construction and operation: new roads must meet VDOT standards and new entrances must comply with VDOT standards for separation, sight distance, turning radius, and corner clearance.
