Restrictions & requirementsHide restrictions & requirements5
A conditional use permit is required to construct and operate the Nebo North data center campus; the county scheduled a public hearing before deciding the application.
All federal, state, and local rules and regulations must be met as a condition of the permit.
Construction and project traffic must use county roads that are brought to and maintained under Juab County road standards. A road-impact study or written analysis must document the need and scope of required work, with the County Road Superintendent determining necessary improvements.
All on-site roads must accommodate fire apparatus and other heavy emergency vehicles, including adequate turnaround areas of approximately 99 feet in diameter or another size approved by the county and fire authority, so emergency vehicles do not have to back onto public roads.
Project-related purchases, including construction materials, furnishings, and equipment racks—and, where legally permitted, computers and server equipment—must have sales tax collected at the county-assigned project address. The applicant must make good-faith efforts to use contractual point-of-delivery provisions or similar mechanisms to allocate applicable sales-tax revenue to Juab County.
Benefits & exceptionsHide benefits & exceptions4
The Planning Commission approved Nebo North LLC’s conditional use permit to construct and operate a data center campus on the specified parcels, subject to the listed federal, state, and local requirements.
The project may obtain power through the Utah SB 132 process, including a reported 750-megawatt request to Rocky Mountain Power. The project would pay for its own infrastructure upgrades and higher-than-standard power rates, rather than shifting those costs to ordinary ratepayers.
County roads used by project construction and traffic must be improved and maintained to county standards, with a road-impact review determining needed work. This provides a process for accommodating the project’s heavy-truck access, although the permit does not waive road standards.
The development’s internal roads must be designed for fire and other heavy emergency vehicles, including adequate turnaround areas, allowing emergency access without requiring vehicles to back onto public roads.
