The Data Center Divide

City of Seagoville

Pro-Data Center Policies

Seagoville’s enacted measure allows data centers in Light Manufacturing districts and rezones a specific 138-acre site for one, subject to planned-development rules; it does not apply citywide.

current law · City of Seagoville
This zoning amendment added a definition for data centers and added data centers as an allowed use in the LM Light Manufacturing district.Seagoville Ordinance 2024-25 (2024)

What this means

The measure would allow data centers in the Light Manufacturing district and rezone a 138-acre site for a data center, creating a substantial new development opportunity (allow Data Center Use). But it does not apply citywide: projects remain subject to zoning, and the specific site would have planned-development rules (138.004 acre tract).

Restrictions & requirementsHide restrictions & requirements8
  • Data centers are permitted only in an LM Light Manufacturing District; land and buildings in that district may be used only for listed or like and similar uses, and HM Heavy Manufacturing uses are excluded. LM use restrictions

  • A building may not exceed six standard stories unless it is set back one foot from every lot line or required yard line for each foot above six stories. If the lot adjoins a single-family, two-family, or Apartment District, the limit is three stories unless the same additional setback is provided. Height regulations

  • Where a street is less than 60 feet wide, a manufacturing or commercial structure must be at least 30 feet from the street centerline. If a block has frontage partly in LM and partly in a more restricted district, the more restrictive front-yard rules apply. Front-yard exceptions

  • A side yard is required where the lot adjoins a single-family, two-family, or Apartment District without an intervening alley: 10 feet or 10% of the lot's average width, whichever is smaller, but never less than five feet. Side-yard requirement

  • A rear yard is required when the lot abuts a single-family, duplex, or Apartment District: 20% of the lot depth, with a minimum of 10 feet and a maximum of 24 feet. The requirement is waived if an alley separates the use from the residential district. Rear-yard requirement

  • All main buildings must use exterior fire-resistant masonry construction and comply with the city building and fire codes. Exterior construction requirement

  • For the approximately 138.004-acre tract at 1900 East Farmers Road, the proposed data-center authorization requires changing the zoning from Agricultural to Planned Development with a Light Manufacturing base zoning and includes development regulations and concept-plan approval. Proposed zoning change

  • The ordinance adding data centers as an LM use provides for a penalty of up to $2,000 for each offense. Penalty provision

Benefits & exceptionsHide benefits & exceptions8
  • Data centers are expressly permitted as a use in the LM Light Manufacturing District.

  • Buildings may be up to six standard stories without additional setbacks; greater height is allowed if the building is set back one foot for each foot above six stories. If the site adjoins a single-family, two-family, or apartment district, the limit is three stories unless the additional setback is provided.

  • For commercial or manufacturing uses, no front yard is generally required, except that a 30-foot setback from the street centerline applies where the street is less than 60 feet wide, and the more restrictive district's front-yard rules apply in certain mixed-frontage blocks.

  • For commercial or manufacturing uses, no side yard is generally required, except for a side adjoining a residential district without an intervening alley, where a five-foot minimum applies and the required width is ten feet or ten percent of average lot width, whichever is smaller.

  • For commercial or manufacturing uses, no rear yard is generally required unless the lot abuts a residential district without an intervening alley; then the rear yard is 20% of lot depth, subject to a ten-foot minimum and a 24-foot maximum.

  • Nonresidential lots may be less than 60 feet wide; the 60-foot minimum applies to residential uses.

  • For manufacturing, industrial, processing, warehouse, storage, repair, lumber, and supply uses, parking is based on one space per five employees on duty at any time; if employee numbers are indeterminate, the requirement is one space per 1,000 square feet of floor area.

  • The November 18, 2024 agenda proposed rezoning approximately 138.004 acres at 1900 East Farmers Road from Agricultural to a Planned Development with Light Manufacturing as the base zoning and authorization for data center use, subject to development regulations and concept-plan approval.
