The Data Center Divide

City of Red Oak

Pro-Data Center Policies

Red Oak allows a data center and supporting structures on one specific property, subject to its plans and existing local rules; this does not apply citywide.

current law · City of Red Oak
Red Oak Ordinance No. 24-041 amends Planned Development 66 Revised 5 to add a data center and auxiliary structures on Lot 2, Block A, Alamo Mission Addition.Texas Red Oak Ordinance 24-041 (2024)

What this means

The measure allows a data center and supporting structures on a specific Red Oak property, making development there easier. It is limited to that site and requires compliance with attached plans and existing local rules, so the benefit is meaningful but narrow (adds a data center to the planned development).

People behind it

  • Enacted and approved Ordinance No. 24041, amending the city's comprehensive zoning ordinance and approving the zoning change.

  • Participated in the ordinance process by providing notices, holding hearings, and considering the proposed zoning change.

Restrictions & requirementsHide restrictions & requirements6
  • Data centers and auxiliary structures are authorized only through the PD-66R6 zoning change and only on Lot 2, Block A, of the Alamo Mission Addition, rather than throughout the city.

  • The property must be used, developed, and maintained for a data center and associated auxiliary uses in compliance with the applicable development regulations, city building code, and related ordinances.

  • Development, use, and maintenance must comply with the Development Plan, Landscape Plan and Elevation Plans, which are incorporated into the ordinance and serve as development regulations for the property.

  • The owner or occupants must also comply with local subdivision, zoning, development, fire, and building codes.

  • The existing regulations for PD66, PD66R, and PD66R1 through PD66R5 remain applicable except where specifically amended by the ordinance, so the data center remains subject to those prior planned-development standards.

  • Violations may result in a fine of up to $2,000 per offense, and each day the violation continues is a separate offense.
