Briscoe County
Mixed Data Center Policies
Texas combines substantial, long-term sales-tax breaks for qualifying large data centers with grid-connection studies, fees, and infrastructure costs that can make projects slower and more expensive. Some large facilities may also face emergency power reductions or grid-stability requirements; the tax benefits have demanding eligibility conditions.

pending · County measureAnnounces that Briscoe County’s Commissioners Court would consider designating Reinvestment Zone #6 at its November 9, 2026 meeting, making approximately 403 acres near Soluna’s existing “Dorothy” data center eligible for property-tax abatement under Chapter 312, subject to county guidelines; the notice does not state that the zone or any abatement has been approved.Briscoe County Notice of Public Meeting — Reinvestment Zone #6 and Soluna Data Center Tax Abatement (2026)
What this means
The proposal would designate land for a data center project as a reinvestment zone and allow the county to consider property-tax abatement agreements for it (data centers and related improvements). Texas describes abatements as exemptions on increased property value for up to 10 years, but the notice does not specify the agreement’s terms, and approval is not certain (up to 10 years).

Briscoe County may designate the approximately 403.397-acre Soluna property as Reinvestment Zone #6, making the data-center improvements eligible for a Chapter 312 property-tax abatement. The proposed improvements include data centers and related ancillary facilities, business personal property, and equipment. The designation and abatement remain subject to the Commissioners Court’s guidelines and criteria and are not automatic.
A Chapter 312 abatement agreement may exempt increases in the value of qualifying property from taxation for up to 10 years. The agreement would have to be approved by the county and would apply through a local agreement with Soluna or its affiliates; school districts may not enter into Chapter 312 abatement agreements.
