The Data Center Divide

Raccoon Township

Anti-Data Center Policies

Pennsylvania requires data centers over 25 MW to obtain local approvals, secure power for their full demand, cover project-related grid costs, and meet added community, jobs, environmental, and reporting obligations. These rules may raise costs and delay or prevent covered projects, but do not ban them.

Benefits & exceptionsHide benefits & exceptions3
  • The C-2 Highway Commercial District permits several potentially compatible industrial and logistics activities by right, including light manufacturing and fabrication, warehousing and storage, wholesale distribution, packaging and delivery services, and truck terminals. A data center would need to qualify under an applicable listed use because the ordinance does not expressly name data centers. These uses are permitted by right.

  • An integrated industrial area may be approved as a conditional use when it combines permitted C-2 industrial uses on one contiguous site. The site must be at least five acres, buildings must be set back 75 feet from road rights-of-way and 50 feet from adjacent property lines, and the site must provide specified roads, drainage, water, sewerage, circulation, and professionally prepared plans. Integrated industrial sites may be permitted subject to these requirements.

  • Accessory uses customary to a principal C-2 use are allowed, including automobile and truck parking, which can support operational and service needs for a qualifying data-center facility. Accessory uses include auto and truck parking.
