The Data Center Divide

Jackson Township

Neutral Data Center Policies

Jackson Township requires conditional-use approval for standalone data storage centers in its Industrial District, adding review and uncertainty; related accessory uses and equipment are allowed there.

current law · Jackson Township
Allows data storage centers in the Industrial District only with conditional-use approval, while permitting data-center-related accessory uses and equipment.Jackson Township, Monroe County, Pennsylvania Data Center Ordinance

What this means

A standalone data storage center needs conditional-use approval in the Industrial District, which can add some review time and uncertainty (listed as a conditional use). But data-center accessory uses and equipment are allowed there, so the ordinance does not block all data-center-related activity (listed as accessory uses).

Restrictions & requirementsHide restrictions & requirements6
  • A data storage center in the Industrial District requires conditional-use approval.

  • Data center uses and equipment are listed as accessory uses, so they must be incidental to a permitted principal use rather than stand-alone principal uses.

  • New lots must have at least 43,560 square feet and 150 feet of width, with a maximum depth-to-width ratio of 4:1. A larger lot may be required if well testing, on-site sewage limitations, or other factors warrant it.

  • All lots must meet setbacks of 50 feet in front, 25 feet on the sides, and 35 feet in the rear. In the Route 715 Overlay District, the front setback is 70 feet from the road center line unless another provision requires more.

  • Impervious surfaces may cover no more than 75% of a lot’s gross area.

  • Maximum building height is 50 feet for principal structures and 25 feet for accessory structures; these limits do not apply to agricultural structures.
