current law · City of New Franklin
Proposes a six-month stay on accepting, reviewing, or approving new data-center applications and related uses in New Franklin, during which the City would not issue zoning, building, or other permits for such facilities.Ohio New Franklin Resolution No. 26-R-28

What this means

If enacted, the measure would pause new data-center applications and permits for six months, with one possible six-month renewal, making new development and permit-dependent expansion substantially harder during that period (the stay and renewal terms). It would not itself stop existing data centers from operating, but the temporary moratorium is a major barrier to new projects.

Timing

  • A six-month stay, effective immediately upon passage, bars the filing, acceptance, consideration, review, and approval of all new applications for data centers and related activities or uses. During the stay, the City may not issue zoning, building, or other permits to open a data center. The stay may be extended once for an additional six months by City Council motion, and its broad definition covers facilities, cooling systems, electricity-related equipment, and construction materials incorporated into a data center.
