Ohio offers qualifying data centers significant sales-tax exemptions on equipment, subject to investment, payroll, reporting, and other conditions, while fees apply to participants. New exemption requests are paused, which may raise costs for new projects; data centers are not banned.

Restrictions & requirementsHide restrictions & requirements11
No building, structure, alteration, new use, or change of use may be made or maintained unless it conforms to the zoning resolution.
A data center use not fitting an expressly listed district use may require approval by the Township Trustees after a public hearing and a recommendation from the Zoning Commission.
New buildings and changes in land or building use generally require a zoning certificate before proceeding; certificates may not be issued for uses that do not comply with the resolution.
Industrial or multiple-family development projects require site-plan review and approval by the Zoning Commission before a building permit may be issued.
Development is subject to district-specific limits on building height, lot coverage, setbacks, lot size, frontage, and—in residential districts—minimum floor area.
Industrial buildings abutting residential districts must meet enhanced separation requirements, including a minimum setback of 50 feet or the building height, whichever is greater, in I-2 districts.
Industrial storage must be located in rear yards and screened from adjacent residential or business districts and public streets with an obscuring wall or fence of at least six feet.
Industrial projects must provide off-street loading spaces based on floor area; buildings over 1,400 square feet generally require at least one loading space, with additional spaces required as floor area increases.
Required off-street parking must be provided before a certificate of occupancy is issued, and parking lots require a permit, approved layout, maneuvering lanes, and defined ingress and egress.
Buildings and uses may be subject to exterior-lighting controls, greenbelts, obscuring walls, and other screening requirements under the resolution's general-provision sections.
A lawful nonconforming structure cannot be enlarged in a way that increases its nonconformity; if it is destroyed by more than 60 percent of replacement cost, excluding the foundation, reconstruction must conform to current zoning standards.

I-1 Light Industrial Districts permit warehousing, wholesale establishments, trucking facilities, laboratories, and other similar industrial uses, which can provide a zoning pathway for a data center classified as a similar use. Manufacturing, compounding, or processing must generally occur inside a completely enclosed building, and open storage may require screening.
I-2 General Industrial Districts permit any principal use allowed in I-1 Districts, extending the I-1 use pathway to the more intensive General Industrial District.
I-1 Districts expressly permit public utilities, including necessary buildings, structures, storage yards, and related uses, while I-2 Districts permit heating and electric power-generating plants. These provisions can accommodate utility and power infrastructure serving an industrial facility, subject to applicable district requirements.
The resolution allows other uses of a similar character to listed I-1 uses as principal permitted uses. In I-1 Districts, uses of a similar character to listed special-condition uses may also be approved by the Zoning Commission.
A Planned Unit Development may be approved for large-scale development, and during final-plan review the Zoning Commission may waive or modify individual zoning-district standards when strict application would serve no significant purpose, provided neighboring uses' convenience and general welfare are not diminished.
The Planned Unit Development approval remains effective for two years, with automatic additional two-year extensions while development continues, which can preserve an approved development framework during a phased project.
A lawful nonconforming use may continue after zoning restrictions change, so long as it remains otherwise lawful. The resolution also permits changes in tenancy, ownership, or management of an existing nonconforming use.
A building under construction before a zoning amendment may continue under its prior lawful plans and designated use if actual construction was lawfully begun and diligently carried on before the amendment's effective date.
