current law · Borough of SayrevilleWould impose an 18-month moratorium on developing data centers throughout Sayreville throughout the Borough, prohibiting them in all zoning districts and in Sections 1, 2, and 3 of the Hercules Redevelopment Plan.Sayreville Borough Ordinance 15-26 (2026)
What this means
If enacted, this would block data center development in every zone for 18 months, making new construction and development-related expansion substantially harder (“data centers shall be prohibited from being developed in all zones”). It does not expressly ban continued operation of existing data centers, but the temporary, town-wide moratorium is a severe development restriction.

An 18-month moratorium prohibits the development of data centers in all zones throughout the Borough, beginning on the date Ordinance #15-26 was adopted.
The ordinance defines data centers broadly to include facilities for storing, managing, or processing digital data and related systems; any use with a power density of 2 to 4 megawatts or more per acre is considered a data center. A data center is expressly not classified as a warehouse.
The Hercules Redevelopment Plan is amended to prohibit data centers and datacenters in Section 1 for the same 18-month period, and to temporarily prohibit them in Sections 2 and 3 as well.
