The Data Center Divide

Elsinboro Township

Strongly Anti-Data Center Policies

Elsinboro Township’s enacted ordinance, also called proposed, bars data centers needing zoning approval in every district unless future plan and zoning changes allow them.

current law · Township of Elsinboro
Prohibits data centers and functionally equivalent facilities as uses and structures in every Elsinboro Township zoning district by amending Chapter 115, “Land Development,” as adopted by the Township Committee on June 1, 2026, by a vote of three ayes (June 1, 2026 meeting materials).Elsinboro Township Ordinance 2026-07 (2026)

What this means

The proposed ordinance would prohibit data centers in every zoning district, effectively stopping new facilities and expansions that require zoning approval. It says they could be allowed only if the Township later changes its master plan and zoning rules (data centers are prohibited uses).

  • Data centers are prohibited uses and structures in every Elsinboro Township zoning district, including the CONS, RR-A, LR, MR, and C Districts.

  • The prohibition applies to data centers, internet data centers, cloud data centers, facilities principally used to house computer servers or data-processing equipment, and functionally equivalent facilities under different names.

  • Data centers may not be treated as permitted, accessory, conditional, or public-utility uses under Chapter 115. They could become eligible only if later recommended in the Township Master Plan and specifically designated as permitted or conditionally permitted through zoning amendments.

  • The definition of 'computer center' is limited to facilities where users meet in person to use on-site computers in an office or laboratory setting; it expressly excludes data centers.
