Restrictions & requirementsHide restrictions & requirements5
The countywide moratorium makes data centers a prohibited use during its term and applies to pending and future zoning applications. The definition includes related accessory structures and infrastructure. “considered a prohibited use within the County”
During the moratorium, no new or existing data center may be constructed or expanded, and the County may not accept, review, process, or approve an application for such construction or expansion. “no new or existing data enter shall be constructed or expanded”
The County must pause further review or work on previously accepted applications involving data-center construction or expansion. Those applications must be withdrawn, acted on under the ordinance, or—if the applicant agrees in writing—have their statutory review period extended indefinitely so the County acts only after the study and any relevant zoning amendments take effect. “may be extended indefinitely”
The moratorium takes effect upon passage and publication and lasts one year, unless the County Board repeals it earlier; it also ends when amendments expressly regulating data centers take effect. “a duration of one year”
Violations may be enforced through criminal prosecution or civil proceedings, including an injunction. A violator may face a misdemeanor conviction, up to 90 days’ imprisonment, a fine of up to $1,000, or both, plus prosecution costs; each day of violation is a separate offense. “Each day that a violation occurs”
