The Data Center Divide

Jefferson Parish

Neutral Data Center Policies

Jefferson Parish allows data-processing and hosting services in several industrial districts, but covered data-mining centers must meet added noise, utility, and equipment requirements.

current law · Unincorporated areas
Allows data-processing facilities in some industrial zones, but requires data-mining centers to meet noise, heat, exhaust, and utility rules, and crypto-mining centers to get special-use approval in heavy-industrial zones.Jefferson Parish Unified Development Code, Chapter 33, Table 33-3.40-1 and § 33-5.3.7.1 (Data Processing, Hosting, Storage and Data Mining Centers)

What this means

Data-processing and hosting services are allowed by right in several industrial districts, giving some certainty about where data centers can locate. But covered data-mining centers face added requirements for noise, utilities, and equipment, so the benefits and limits roughly balance.

Restrictions & requirementsHide restrictions & requirements8
  • Data processing, hosting, and related services, a classification that may cover conventional data centers, are prohibited in the I-LF Landfill Industrial District and the OBM-1, OBM-2, TCMU, FC-1, and FC-2 mixed-use districts.

  • Cryptocurrency data-mining centers are prohibited in the I-MU, I-L, I-LF, and AIM industrial districts and in the OBM-1, OBM-2, TCMU, FC-1, FC-2, FC-3, and U-1S mixed-use districts.

  • Cryptocurrency data-mining centers require approval as a special permitted use in the I-H industrial district and the U-1R mixed-use district, rather than being allowed by right.

  • A data-mining center designated as a special permitted use may not operate until the special-permitted-use application is reviewed and approved by the Jefferson Parish Council, with all required conditions satisfied before approval.

  • Noise, exhaust, heat, and humidity from a data-mining center must not be perceptible at or beyond the property line. A facility within 500 feet of a residential district or use must submit a noise-mitigation plan.

  • A data-mining center may not create electric or magnetic fields that adversely affect public health, safety, or welfare, including interference with equipment, instruments, or off-site radio, telephone, or television reception.

  • Cargo containers, railroad cars, semi-truck trailers, and similar storage containers may not be used for any component of a data-mining operation.

  • Before special-permitted-use approval, the applicant must obtain written verification from the applicable utilities that adequate capacity exists, the infrastructure is properly sized and safe, and the facility will not cause electrical interference or line-voltage fluctuations on or off the premises.

  • Data processing, hosting, and related services—the classification covering typical data-center operations—are permitted by right in the I-MU, I-L, I-H, and AIM industrial districts, but are prohibited in I-LF. Industrial use matrix

  • Data processing, hosting, and related services are permitted by right in the FC-3 Commercial Mixed-Use, U-1S Unrestricted Suburban, and U-1R Unrestricted Rural districts, subject to each district's standards. Mixed-use matrix

  • A data-mining center using specialized cryptocurrency-mining equipment may locate in the I-H Heavy Industrial District with special permitted-use approval; it is prohibited in the other industrial districts. Data-mining-center matrix

  • Industrial dimensional standards allow relatively flexible facility design: I-MU has no minimum nonresidential lot area, depth, or width; I-L and I-H require a minimum 5,000-square-foot lot area; and these districts generally have no maximum building height. Height and setback limits still apply near residential zoning. I-MU standards, I-L standards, and I-H standards

  • Accessory offices and other accessory uses, including restaurants, cafeterias, retail outlets, and wholesale outlets, are allowed in industrial districts when operated with and located on the same site as a permitted industrial use. Authorized accessory uses

  • Mechanical equipment serving a permitted data center is authorized in industrial districts, subject to the UDC's site-design requirements. Mechanical-equipment provision

  • Certain changes to an industrial data-center facility are exempt from site-plan review, including interior renovations, routine exterior maintenance, and changes of use that do not increase required parking. Additions below the specified 50-percent threshold generally avoid review in I-MU; in I-L and I-H, the 50-percent rule applies when the district is adjacent to or across a street from a nonindustrial district. I-MU exemptions and I-L exemptions

  • In the AIM Avondale Industrial Marine District, internal lot lines may be disregarded and parcels may be treated as one development site when tied together by common ownership, a servitude, lease, or similar agreement, facilitating a unified or phased campus. Single-development-site provision

  • Before a data-mining center is approved, utilities must verify in writing that supply lines and substations have adequate capacity, that utility equipment and electrical infrastructure are properly sized and safe, and that the facility will not cause off-site electrical interference or voltage fluctuations.
