Restrictions & requirementsHide restrictions & requirements4
A 12-month moratorium prohibits the City from accepting, processing, or approving applications to establish, construct, expand, or develop a data center within the City's zoning jurisdiction. It covers rezoning, conditional or special-use approvals, site plans, plats, development approvals, zoning permits, building permits, and other municipal land-use or development approvals.
During the moratorium, the Planning Commission may not recommend or approve data-center development applications, except for actions needed to consider and recommend permanent zoning regulations governing data centers.
The moratorium remains in effect for 12 months from its effective date unless the governing body repeals it earlier or permanent data-center zoning regulations are adopted and become effective.
The moratorium applies to facilities principally used for servers, data-processing equipment, networking equipment, digital storage, or related infrastructure, including hyperscale, cloud-computing, colocation, artificial-intelligence, and cryptocurrency facilities; ordinary server rooms and information-technology equipment accessory and incidental to a property's principal use are excluded.
Benefits & exceptionsHide benefits & exceptions4
Ordinary server rooms and information-technology equipment that are accessory and incidental to a property’s principal use are excluded from the definition of a “Data Center,” so they are not subject to the moratorium.
The moratorium applies only within the City of Marysville’s zoning jurisdiction, so data-center projects outside that jurisdiction are not covered by this ordinance.
The ordinance restricts the acceptance, processing, and approval of development applications but does not prohibit the continued operation of existing data centers.
The moratorium lasts 12 months unless repealed earlier or superseded by permanent regulations, limiting the duration of the restriction on data-center development applications.
