People behind it

  • Authorized to initiate text and zoning-map amendments and approve zoning actions under the ordinance.

  • Reviews and recommends conditional-use, zoning-amendment, and comprehensive-plan measures, and decides variance and administrative-appeal matters.

  • Responsible for implementing and enforcing the zoning ordinance and processing applications.

Restrictions & requirementsHide restrictions & requirements3
  • Data centers are expressly prohibited in every zoning district listed: Residential/Agricultural (RA), Town Residential (TR), Town Mixed Use (TMX), Institutional (I), and Light Assembly Manufacturing (LAM). The definition expressly includes facilities conducting cryptocurrency activities.

  • The Planning and Zoning Board may not grant a use variance or otherwise establish a use that is neither a permitted nor conditional use in the applicable district. Because data centers are prohibited uses, the ordinance does not provide a variance route to authorize one.

  • No structure or land may be used, altered, enlarged, or have an existing use expanded except in full compliance with the ordinance and after issuance of all required permits and certificates. This independently bars construction, expansion, or operation of a data center that is not authorized under the zoning rules.

Benefits & exceptionsHide benefits & exceptions3
  • Grandfathering of complete building-permit applications: A full and complete application filed before the ordinance’s effective date is governed by the prior zoning ordinance, including its prior data-center rules, although the new ordinance’s administrative procedures and penalties apply. Any application for a Building Permit that has been filed

  • Protection for pending non-building applications: A full and complete zoning-map amendment, conditional-use, variance, or land-use application filed before the effective date continues under the prior ordinance. If the requested use or district is no longer available, the Zoning Administrator must amend the application to pursue the same end goal or include only newly required approvals. Any application before the Mayor and Town Council

  • Continuation of lawful preexisting operations: A lawfully established data center that becomes nonconforming because of later zoning restrictions may continue operating, unless the property is vacant for more than 12 consecutive months or the building is damaged beyond 50 percent of its value. Such use shall be allowed to continue
