Restrictions & requirementsHide restrictions & requirements7
Imposes an 18-month moratorium, effective immediately upon adoption, on submitting or accepting applications related to data centers, large-scale data centers, and large-load utility users.
During the moratorium, the City may not consider or issue building permits, site-plan approvals, development orders, development agreements, special-exception or conditional uses, rezonings, comprehensive-plan amendments, or other official approvals for covered facilities.
The moratorium applies to all data center types, including smaller facilities that meet the technical definition of a data center, as well as large-scale data centers and other large-load utility users.
The City must suspend action on pending applications for covered facilities, accept no new applications, and permit no new covered activities or facilities while the moratorium is in effect.
The City must return funds accepted for pending applications, permits, approvals, or business tax receipts covered by the moratorium.
The City Commission may extend the moratorium for additional periods of up to 90 days per extension if it finds that the underlying issues continue, corrective legislative action is progressing, and additional time is reasonably needed.
The restrictions apply throughout the City's corporate and municipal boundaries, including areas later added through annexation.
