current law · Unincorporated territoryProhibits Prowers County from accepting, reviewing, or acting on applications for data center projects in unincorporated areas for six months after adoption, unless ended or extended sooner.Prowers County Resolution No. 2026-___, Temporary Moratorium on Processing Special Use Permit Applications for Data Center Projects (2026)
What this means
If enacted, the measure would stop the county from accepting, reviewing, or acting on data center development applications in unincorporated Prowers County for six months, creating a serious delay for new projects (six-month moratorium). It does not expressly stop existing data centers from operating, but the temporary permitting freeze is a substantial barrier to building or expanding during that period.
